KBH has extensive experience and expertise in advising and managing property related transactions and acquisitions, including in project financing, advising on title and land use, regulatory and licensing requirements for commercial activity, commercial leases, and all aspects of property conveyances and transfers including lending and mortgage-backed securities aspects.

We also advise and act in landlord and tenant matters, and have a depth of practical experience across all our offices in advising on the mutual rights and obligations of co-owners and partners in commercial property investments, as well as in dealings with property intermediaries and financial institutions.

On the contentious side, we have acted in the leading cases in the region relating to mis-selling of property-backed investments, the duties and liabilities of lenders and co-lenders, and the specific and special contractual remedies available to parties to property disputes under the DIFC Contract Law and the DIFC Real Property Law.

Our dispute resolution team includes two senior barristers who are experienced in managing and leading our clients through all aspects of the construction disputes process, including claims preparation, disclosure, all pleadings and advocacy, and managing experts and conducting trials.

The firm is in a position to act for clients across the range of participants in the construction industry, including on behalf owner employers, contractors and subcontractors, developers, designers, engineers, architects, lenders, investors and insurers. We have detailed knowledge of FIDIC rules and of the international arbitration rules and precedents central to construction arbitrations.

As in other areas of our disputes practice, in cases where they are agreed as mutually beneficial for us and our clients, KBH is in a position to consider and offer alternative fee structures, including contingency, success fee and flat fee arrangements, in property and construction related disputes.
